The convicted Sambo in his statement to the police which was tendered in court, confessed to have beaten Yahaya with a whip when he caught him red handed, having carnal knowledge of his wife in the bush close to their village. He however, told the police that he never knew that Yahaya died until he was told by the police on the day he was arrested. He added that the deceased also injured him with a knife
“I left my village on that day to Karini market in Bayo Local Government Area and I met my wife there and bought a meat and gave it for her to cook for me. I decided to follow her without her knowledge because I had been suspecting that she and Bappa were having an affair.
So I traced them to a bush where I met her with Bappa having sexual intercourse. I saw them with my naked eyes when she pulled off her wrapper and he used her like a dog. I beat him seriously with a whip and took all his dresses, shoes, knife, charms and the sum of N14,000. I only used hand and whip to beat him and he fell onto a stone and was injured seriously on his neck. Thereafter, I reported the incident to my Bulama while one man went and informed his brother and one Hamidu Baba,” part of the accused statement to the police read.
Among those who had earlier testified in the court was the wife of the accused, Hauwa who told the court that Sambo informed her that he has killed her lover (Yahaya).
Jauro Malam, another witness, told the court that he saw the deceased in a pool of his blood naked and he told him that Sambo did it to him, adding that Yahaya, the deceased, died the second day of the incident.
The accused was said to have committed the offence on the 17th of April,2003 and is charged with culpable homicide which is punishable under section 221 of the penal code but the charges was later converted to section 224 of the penal code also culpable homicide but not punishable with death.
Counsel to the accused, Barrister B. Musa, in his defence, urged the court to temper justice with mercy, saying the accused is a young man with an aged mother and little children and that he has spent seven years in prison. He also said that the accused was provoked, saying no man will ever withstand watching another man having sexual intercourse with his wife.
