The Industrial Court of Nigeria in Abuja has refused an interlocutory injunction seeking to stop the appointment of a new Accountant General of the Federation until the determination of the case.
Justice Rekiya Haastrup, during her ruling on Wednesday, said the issues should be determined together with the main issues.
A participant in the selection process and a director of the federal civil service, Joshua Kadmi Luka, had filed the application, through his counsel, Ibrahim Angulu (SAN), seeking to stop the process for the appointment of a new Accountant General of the Federation until the case is determined.
Angulu had argued that “Constitutionally, it is the Civil Service Commission and not the Head of Service, HOS that should supervise the conduct of the selection process, saying the action of the defendant are unconstitutional.

“It is also our contention that a mere allegation of crime without conviction, cannot be used to exclude the claimant. The law is very clear, he has not been found guilty, so because of a mere allegation he is excluded.
He concluded that even though the appointment of the Accountant General lies with the president, the process lies with the Civil Service Commission and not the office of the Head of Service.”
In the originating summons, the claimant is asking the court for a declaration and /or order of the court that the process of selection of the Accountant General begun by the Head of Service of the Federation is null and void as she has acted in contravention of the constitution and over her powers.
The suit has been adjourned to March 25 for a hearing.
