An FCT High Court has set February 26 for hearing in the suit by passenger, David Anikoh over a breach of contract with an airline.

Justice Modupe Osho adjourned the suit last week to enable Azman Air Services to open their defence in the suit after Anikoh adopted his statement of claims.

Anikoh said his journey to Geneva, Switzerland on March 30, 2019, was disrupted without apologies or refund from Azman Airline. He said he was to make the trip on return from Lagos and had booked a return ticket of N39,000 on March 7, 2019 from Abuja to Lagos and Lagos back to Abuja from March 29, 2019 by 3pm.

In the suit brought by his counsel, David Seidu, Anikoh is demanding the sum of N5m damages from the airline for breach of contract through the last-minute rescheduling and cancellation of his flights and non-refund of the money paid as air fare “and the attendant financial, psychology and mental suffering.”

He also wants the court to award the sum of N200, 000 cost of the litigation and 10 percent post judgement interest sum of the entire judgment sum until judgment sum is liquidated.
