Akwa Ibom”s Senate tussle: Judge withdraws from Sen. Akpan”s suit

A Federal High Court judge in Abuja, Justice Nnamdi Dimgba has withdrawn from a suit challenging the removal of Senator Bassey Albert Akpan, representing Akwa Ibom East Senatorial zone.

Justice Dimgba said a publication on an online website made insinuations against his person over the proceeding of the court on March 8th, 2017.

He said the publication has put him in a difficult position which will discredit any decision he makes in the matter.

He therefore remitted the case file to the Chief Judge, Justice Ibrahim Auta for re-assignment.

Justice Fatun Riman on February 27 sacked Senator Albert Bassey Akpan as the Peoples Democratic Party (PDP) Senator for Akwa Ibom North-East Senatorial District, and ordered the Independent National Electoral Commission (INEC) to issue a certificate of return to Hon. Bassey Etim.

Akpan had approached the court with an ex-parte application seeking interim preservatory orders against the Independent National Electoral Commission; the President of the Senate; Clerk of the National Assembly and Clerk of the Senate over the order of the court in Uyo while he pursues his appeal at the Appeal Court.
