Appeal Court upholds N7.6m award against Neimeth Pharmaceuticals

Abdullahi Ladan, who facilitated the supply of drugs by Neimeth PLC to the Kaduna State government in 2010, had sued the company after it failed to pay him the agreed charges.
Neimeth was awarded the contract to supply 38 doses of Nimartem brand of ACT for the state’s Roll Back Malaria programme. Ladan was to earn N200 on each unit supplied under the agreement. He averred that the company was paid N20.9 million after the execution of the contract.
Justice S.U. Sukola of Kaduna High Court had on February 3, 2013 ordered the drugs’ firm to pay the sum of N7.6 million and another 10 per cent interest per annum on the sum until the amount is liquidated. The judge also ordered the company to pay the sum of N25,000 cost of filing the action.
Following an appeal by Neimeth Pharmaceuticals, the Appeal Court on April 14, 2014 dismissed it for want of diligent prosecution.
