A Federal High Court in Abuja has dismissed the applications by former president, Goodluck Jonathan and former National Security Adviser (NSA), retired Col. Sambo Dasuki to vacate the subpoena to testify in the trial of former PDP spokesman, Olisa Metuh.
Justice Okon Abang struck out the application of Jonathan to set aside the subpoena for being based on hearsay as the subpoena has not served on him.
The judge said that Jonathan learnt of his summons by media reports robbed the court of jurisdiction to make a pronouncement either substantive or declaratory in his application.
Justice Abang also dismissed the application by Dasuki seeking to adjourn the trial pending the conclusion of the appeal challenging the subpoena at the Court of Appeal in Abuja.
The judge ruled that accepting the application will be an affront on the unanimous decision of the Court of Appeal on Septembee 29 as well as Section 287(2) of the Nigerian Constitution.
He therefore ordered Dasuki to immediately mount the dock to give his evidence.
