A Federal High Court sitting in Kano had refused the application of a Kano-based musician, Abdul Kamal, to stop the Hausa Service of British Broadcasting Corporation (BBC) from using his soundtrack without his consent.

The court said since it is at the discretion of the court to allow or to stop the media outlet from the use of the soundtrack, it held that the application for interim order lacked merit.

The court, instead, ordered for accelerated hearing of the substantive suit.

Daily Trust reported that Kamal had sued the BBC Hausa Service for using his sound track in their popular programme, “Daga Bakin Mai ita,” without his consent.

The defence counsel, Barrister Shakiruddeen Mobuluwaji, told the court that the plaintiff counsel was yet to respond to the counter application.

The plaintiff counsel, Barrister Bashir Ibrahim, argued that he had already served the defence counsel with the appropriate responses on time.

The presiding judge, Justice Muhammad Nasir Yunusa, asked the parties in the case to confirm responses and adjourned the case to March 20, 2024.
