A Federal High Court sitting in Jos has on Friday, declared Hamisu Mohammed Anani as the authentic House of Representatives’ candidate of the Peoples Democratic Party (PDP) for Wase federal constituency of Plateau State.
Delivering the judgement, the presiding judge, Musa Kurya said that the facts before the court have confirmed that Anani – Plaintiff in the case- as the PDP’s candidate for the 2019 general election for Wase federal constituency.
It recalled that in a suit No: FHC/J/CS/49/2018 a plaintiff – Hamisu Anani filed a case before Federal High Court sitting in Jos urging the court to declare him as the winner of the PDP primary election for the House of Representative seat for Wase federal constituency held on 2nd December, 2018.
The case has Umar Suleiman Rabo, Peoples Democratic Party (PDP) and Independent National Electoral Commission (INEC) as the 1st, 2nd and 3rd defendants respectively.
Anani told the court that he won the said primary election with 152 votes against the 1st defendant (Rabo) with 140 votes, but the 2nd defendant (PDP) submitted the name of the 1st defendant to the 3rd defendant (INEC) as the winner of the election.
But during today’s judgement, Justice Kurya said from the fact before the court he was in a view that the plaintiff has satisfied all conditions in the said election and the judgement was hereby entered in favour of him against the defendant.
He said, “From the facts before me, I am here of the view that the Plaintiff has satisfied all conditions having the highest number of votes and was issued with the requisite for CFOO1 and form EC4B dated 17th October, 2018,
“Which qualifies him eligible to have his name recognized, declared and submitted to the INEC by the 2nd Defendant (PDP) as her candidate for the 2019 general election for Wase federal constituency.” He said.
The judge didn’t also awarded any cost to all parties that appear in the case.
