A Yola High Court presided over by Justice Nathan Musa has dismissed a case that was filled by dissolved executive council members of the Social Democratic Party (SDP).

The dissolved council which was headed by Ibrahim Rahman Bebetu and twenty others has dragged the SDP to court over the termination.                       

The national headquarters of the party, Honourable Emmanuel Bello, Major General Zarwa (rtd) and 21 others were part of the suit.

The lawyer to the plaintiff (Chief Linus Nzadon) in a sworn affidavit wrote that the dissolution of the tenure of his client is on the ground that the tenure is supposed to end by December 2018.

He objected that the dissolution prevented his executive client to complete their four years in office provided with the 1999 constitution as amended by the SDP constitution.

Appearing for the defendant, Eyitayo Jegede SAN had disputed the submission of the plaintiff’s counsel that the election which brought the dissolved executive into power was not properly conducted.

He reiterated that the dissolved excos had outlived their usefulness and are dissolved with accordance of the constitution.

Justice Nathan Musa, after a thorough review of the submission of counsels to the plaintiff and defendant, dismissed the suit.

The newly inaugurated Chairman of the SDP, John Muva, said he was very pleased with the judgment.
