Court orders Gowon centre to pay N26.4m over breach of contract

The High Court sitting in Jos, Thursday, has ordered General Yakubu Gowon’s Centre to pay the sum of N26.4m to a civil society group in malaria control, Delybimb Malaria Foundation over breach of contract signed by the parties in 2010.

The judge also ordered the centre to pay the sum of N100, 000 for the total cost incurred on the group.

Delybimb Malaria Foundation has sued the Incorporated Trustees of Yakubu Gowon Centre founded in 1992 by the former head of state General Yakubu Gowon for failure to pay the contract of store identification, assessment and distribution of long lasting insecticidal nets in Zamfara, Borno and Plateau states.

The group entered into business transaction with the centre in July 2010 for the implementation of Global Fund Round 8 Malaria Grant and requested for defendants’ services to carry out the store identification, assessments and distribution of the global nets that had arrived in Nigeria then.

But an alleged breach in contract and failure to resolve the issue amicably made the group to sue the centre in a case that suffered series of adjournment.

While giving the verdict the High court judge, Justice Pius Damaluk said his court ruled in favour of the group after examining all the evidence and counter-evidence tendered by the counsel of the plaintiffs and defendants Ibrahim Hamma and Mrs. D.G Manaseh respectively.

The defendant counsel Mrs. Maneseh conceived the verdict and accepted to bear no cost.
