Court stops Nasarawa govt from constructing mega bus terminal

A High Court in Nasarawa State has given a perpetual injunction restraining the state government from building a modern mega bus terminal on a private property pending the determination of a suit before it.

In a suit, number NSD/mg/14/2020, filed by Chief Vundabo Iya (for himself and on behalf of the Dache family of New Nyanya, Karu, Nasarawa State) against the Nasarawa State Government, the Attorney General and Commissioner for Justice, Nasarawa State, and the Commissioner for Lands, Survey and Country Planning, Nasarawa State, the plaintiff sought for an injunction “restraining the defendants and each of them by themselves or though their agents, servants, privies or anyone acting through them from doing, interfering or carrying out any act on the plaintiff’s family land at Gwopeyi, opposite the Muhammadu Buhari International Market, Karu.”

The exparte motion is pursuant to Order 41 of the High Court of Nasarawa State (civil procedure) 2010 and under the inherent jurisdiction of the honourable court.

The declaration contains that the plaintiff’s family’s rights over the land exist and have not been revoked and therefore any allocation, Right of Occupancy (RoO or  Certificate of Occupancy (CoO) issued to anybody or authority over the same land or any portion thereof is a worthless document as there cannot exist concurrently two title holders over the same land.

The plaintiff is also demanding N50m as general damages and N5m for cost of court action.
