Family appeals judgment in alleged baby theft suit

The family that accused a hospital of stealing one of its twin babies has appealed the judgment of the FCT High Court.

Bankole Owolabi, a staff of a construction company in Abuja instituted the suit claiming that after the hospital scan showed that his wife was carrying a set of twins, she was later said to have delivered only a baby girl in suspicious circumstances.

Justice Jude Okeke in September awarded the sum of N1.05 million to the Owolabi family against King’s Care, Abuja.

But counsel to the family, Maxwel Okpara, on Monday, filed a Notice of Appeal before the Court of Appeal in Abuja demanding an order of court for the hospital to produce the second baby as obtained in the scan.

The family is also demanding an increase in the damages awarded against the hospital.

Delivering a judgment, Justice Okeke had held that the family failed to prove the allegation of theft against the hospital.

He however award cost against the hospital for emotional trauma caused the couple by the hospital’s scan test that showed a set of twins – a boy and a girl.
