Justice Gabriel Kolawole adjourned the matter to February 5 after he announced his inability to sit on Thursday.
Hassan Saleh, who also contested for the Ado, Okpokwu and Ogbadibo Federal Constituency of Benue State, claims Abah forged the National Diploma (ND) certificate of the Federal Polytechnic, Mubi in Adamawa State for clearance to participate in the primaries of the PDP for the 2015 general elections.
In the suit filed by his counsel Matthias Emeribe, Saleh wants the court to declare that the ND in Accountancy purportedly obtained on August 31, 1986 from the polytechnic, which was presented to the Independent National Electoral Commission (INEC) for the December 6 primaries, was forged.
He averred that he had petitioned the PDP Legal Adviser and the Inspector General of Police complaining that by virtue of paragraphs 22(d) and 24(2) of the PDP guideline for the conduct of the elections, Abah had given false information which ought to disqualify him from the race.
He averred that he successfully challenged the candidate’s attempt to present same certificate for the 2011 general elections in suit FHC/ABJ/CS/195/11 before same judge of the Federal High Court, Abuja which made him withdraw from the race.
