Hearing in the suit filed before a Lagos Federal High Court was stalled due to the absence of the Director-General of SON, Joseph Odumodu who is the first defendant in the case.
Plaintiff’s counsel Mr Ogbonnaya Agbafo told the court that SON’s officials refused to sign for the court processes taken to them and therefore went ahead to ask for a short adjournment to enable him find an alternative means of serving the process. Justice Saliu Saidu adjourned hearing on the suit till January 7, 2015.
In an originating summons and affidavit of claims filed before the court, the plaintiff has sought a declaration among other things that the SON is strictly bound and its functions wholly circumscribed by its enabling Act and anything done or proposed to be done by it in contravention of the provisions of that Act is ultra vires of its statutory powers and is therefore null and of no effect.
