Haadis Limited had dragged Costain construction to court over the failure of the company to pay it  N1.5 million, being the cost of the goods it supplied Costain Construction Company
When the matter came up for hearing on Thursday, the defence counsel, Mr Segun Adedoyinbo, who is making his first appearance in the matter told the court that he had just been briefed by his principal and prayed the court to grant them an extension of time to enable them file all necessary papers for their defence.
However, the plaintiff’s counsel, Mr Isaiah Oreweme, informed the court that Costain had been served with a summary summon since last month.
The presiding judge, Magistrate A.A. Demi Ajayi (Mrs) while making her pronouncement stated that the request for an extension of time by the defence was a delay tactics under the law and that the defendant ought to have filed all the necessary papers for its defence, adding that the rules are not for decoration purposes and all laws must be obeyed.
The magistrate stressed that she had no option than to adjourn the matter for  judgment and thereafter fixed judgment in the case for December 12, 2013.
