Francis Mgboh and Joshua Ezebialu, in a fundamental rights enforcement procedure, also want a mandatory injunction directing the EFCC to release Sanusi Peters, a Deputy Superintendent of Police (DSP) and Akindele Jimoh, a Chief Superintendent Police (CSP).
Mgboh and Ezebialu listed as defendants in the suit three operatives of the EFCC: Bala Mohammed, Bello Mohammed and David. According to the lawyers, Peters and Jimoh were arrested and detained on June 19 for failing to make indicting statements against some of their superiors in the Nigeria Police. The police officers sought a letter requesting the approval of the Inspector General of Police to seek legal redress for the violation of their rights by the EFCC.
The applicants stated that upon receiving the information, they made attempts to get the police officers, who were still in EFCC custody, to sign the letters seeking IGP’s approval, but the EFCC officials detained both of them and threatened them to write in the statement form that they smuggled in letters to the detained police officers.
The counsels aver that any legal redress by the police officers, without the approval of the IGP, will lead to their summary dismissal and forfeiture of their retirement benefits. No date has been fixed for hearing of the matter.
