Industrial Court further adjourns suit against FHA boss to Sept 28

Justice M. N. Esowe last week adjourned the suit after Al-Amin and the acting managing director of the FHA Homes Ltd, Hayatudeen Awwal Atiku, brought an application seeking to set aside the earlier order against.
The court had on June 19 issued an interim injunction against the FHA boss to restore the suspended managing director of FHA Homes Ltd, Roland Igbinoba, who was allegedly handed an indefinite suspension by the board without due process.
However, the board failed to comply with the order to reverse its decisions of June 2 suspending Igbinoba.
At the resumed hearing, Al-Amin’s counsel Tony Ogbulafor told the court that his client was not served with the processes of the court, adding that in contempt proceedings the respondent must be served in person.
But Igbinoba’s counsel Chukwunweike Okafor argued that the procedure in the Industrial Court rules provides that service on a personal assistant of the respondent is deemed proper service.
 In the statements of claim through his counsel Chika Okafor, Igbinoba avers that the board, in an emergency meeting convened on June 2, 2015 by Al-Amin served him a letter of indefinite suspension over allegations of impropriety.
He further averred that a committee, which purportedly investigated and indicted him on the finances and property of the company, submitted its report same day without inviting him to defend himself.
The claimant, who claims that his tenure has not elapsed having been appointed on July 19, 2013 averred that his ordeal was due to his refusal to do the bidding of the FHA boss.
