The Court of Appeal in Abuja has dismissed an appeal by a governorship candidate in Kebbi State, Bello Sarkin-Yaki seeking the disqualification of Governor Atiku Bagudu.
Justice Peter Ige in a judgement on Monday held that Sarkin-Yaki’s appeal is incompetent and failed to prove the criminal allegations that the Governor was convicted in the USA.
A Federal High Court had in June also dismissed the claim against the governor, saying his purported arrest for extradition in May 2003, does not amount to a sentence of any kind.
Sarkin-Yaki and Anthony Itanyi had in the appeal, which joined the All Progressives Congress (APC) and Independent National Electoral Commission (INEC), sought the disqualification of Governor Bagudu for supplying false Information to INEC in form CF.001 about the alleged convictions.
“From the evidence of the plaintiffs, I am of the opinion that he has failed, through his witness that the first defendant was convicted by a court in the United States of America for criminal offence,” the judge ruled.
