But, presiding judge of the Abeokuta Magistrate Court, sitting at Isabo, Magistrate Olusola Sofowora said that hard work was the cure for hunger and as such Ogunbayo’s plea could not be tenable, affirming that the sentence should be without option of fine.

The prosecutor, Inspector Babatunde Sangotokun, told the Court that the theft was committed on August 28, 2009 around1.30pm on a small farm belonging to one, Sunday Osukoya, at Olokuta Housing Estate Kenta, Idi-aba, Abeokuta, Ogun state. He puts the value of the tubers of yam stolen by Ogunbayo at about N10,000.00.
