The deceased who was stabbed in the stomach on May 7, 2007, was rushed to the Gudumbali dispensary and later transferred to Taimakon Jama’a clinic around Custom Area in Maiduguri , where he later died.

The accused who pleaded not guilty in court is charged with culpable homicide punishable with death as provided by Section 221 of the Penal Code. But in his statement given at the Gudumbali Police Station and recorded by Corporal Isa Buba, who also testified before the court, the accused said around 11am, he went to the borehole in their village and had a misunderstanding with the deceased. “He used to call me with a name which I disliked. Hence we fought and I removed a knife and stabbed him on his stomach,” part of his statement read.

Modu Gir-gir, in his witness statement tendered before the court, said he and the deceased were in his shop around the borehole when the accused came and asked the deceased why they prevented him from loading passengers at the motor park but the deceased kept quite. Later, they started insulting each other and the heated argument resulted in a fight. According to Gir-gir, the accused removed a knife and was about to stab the deceased before they were separated, but “as the deceased was repairing his motorcycle, the accused came back and stabbed him on his stomach with a knife.” Justice Patum Haruna Nggada adjourned the case for hearing to July 5, 2010.
