Man, 40, remanded for homicide

A Kano based Chief Magistrates Court sitting at No Mans Land, Sabon Gari has ordered the remand of a 40-year-old man Jibrin Adam over alleged culpable homicide.

Chronicle gathered that the accused person would remain in custody pending the advice of Department of Public Prosecution (DPP).

Adamu was arraigned on one count charge for culpable homicide contrary to section 222 of the Penal Code Law.
The prosecutor told the court that the offence was committed on 9th February, 2019 at Kwanar Huguma Village, in Takai local government area of Kano state.

He said accused person used knife to stab one Yusuf Muhammed during fight which led to his dead at hospital.

The prosecutor told the court that on 9/02/2019, at about 15:30hrs, one Hassan Abdu of Kwanar Huguma village Takai LGA, Kano, reported at Kachako division that on the same date at 15:00, the accused person had a misunderstanding with one Yusuf Muhammed.

He said while fighting Muhammed, now late, used iron rode to hit the accused on the head and in return the accused used knife and stabbed late Muhammed on his chest.

The prosecutor said Muhammed was rushed to the hospital as a result of the injury he sustained but he died while receiving treatment at Dutse General Hospital in Jigawa state.

When the charge was read to the accused he pleaded guilty but the Presiding judge, Chief Magistrate Maryam Ahmed Sabo said the court lacked jurisdiction to pass the judgment saying the court would confer with the department of public prosecution (DPP) for advice.

She, however, ordered that the accused person should be remanded in prison pending the decision of the DPP.
