A 47-year-old man, Abdurazak Abubakar, accused of sodomising a seven-year-old boy was yesterday granted bail by a high court in Kano after two years in a correctional facility.
The case was first mentioned at a magistrate court in Gwammaja in Dala LGA in 2018, but suffered several setbacks over time.
Abubakar of Layin Gidan Kara, Bachirawa quarters in Dala LGA, was said to have on 02/12/2018 lured the boy into his provision store where he sodomised him.
The victim’s father had on the same date reported the matter to the police at Bachirawa station, leading to the arrest and subsequent arraignment of the accused in court.
The action of the accused, according to the police first information report (FIR) deposited at the magistrate court, was an offence and contrary to Section 284 of the penal court.
Counsel to the accused, Barr. Hafsat Sani Kabara, said the case was moved to the high court following lack of jurisdiction of the magistrate court to grant bail on capital offences, rape and unnatural offences.
She said, “The case was first mentioned there; where we applied for the records of proceedings and FIR to enable us apply for his bail,” adding that “for the past two years the accused has been in custody.
“The then judge has been indisposed having travelled out for medical treatment. We applied for redirection and it was redirected to High court 1, we then applied for his bail and was graciously granted at the first sitting”.
The presiding judge, Justice Nura Sagir Umar, granted bail to the accused in the sum of N200,000 with two sureties in like sum with one having landed property in the area and the other to swear to an affidavit.
