One Musbahu Magaji, popularly known as Alhaji Balarabe Bakanike, was forcibly ejected yesterday from a property he was occupying despite a court case going-on on the matter.
While expressing his utter shock, Counsel to Balarabe, Barr. Ibrahim Adamu, said “we are here to witness an execution of an order of court sitting at Danbatta, presided over by Hon. Justice Nasiru Saminu ordering one Sani Ya’u and Hafizu Sulaiman to remove their belonging from the property.
Unfortunately, the order was extended to affect my client Alh. Balarabe.
“As far as Hon. Justice Saminu is concerned, he did not order them to evacuate everybody from the property.”
The incident occurred yesterday at Kofar Dawanau when one Sani Ya’u and Hafizu Sulaiman, who were having their properties locked up in the disputed property, secured a court order to remove their belonging from the said property.
The High Court of Justice, Dambatta, directed one of its staff to open the premises and witness the evacuation of the properties of the applicants (Sani Ya’u and Hafizu Sulaiman).
On arrival, the court official ordered that everything within the said property should be evacuated including the belongings of Alh. Balarabe Bakanike, who had a judgement passed in his favour earlier by the high court of Kano on the possession of the property and upheld by the Appeal court, Kaduna.
On his part, Hussaini Lawan Dangado, who also claimed ownership of the property, was able to secure an order earlier on from the high court asking Alh. Balarabe to vacate the property.
When contacted, Alhaji Dangado said “even before now, there was a court order asking Alhaji Balarabe to vacate the property. But I dont know whether his name is included in this new order or not, all I know is that I, Hussaini Lawan Dangado, am the rightful owner of the property, because the certificate is bearing my name and you can confirm that at the Ministry of Land”
The dispute started as far back as 1994 between Alh. Garba Ali and Alh. Abdulmudallabi Abdullahi when the matter was taken to high court, Kano, before Justice Wada Abubakar Umar, who passed a judgement in 1999 in favour of one Alh Garba Ali who held the certificate of occupancy allocated to him in 1983 and later sold the property to Alh. Balarabe.
The Judge, Justice Wada Abubakar, passed the judgement in favour of Alh. Garba Ali on the account that the defendants had no defence to offer in the case and ordered the Ministry of Land make another allocation of a piece of land to the Alh. Abdulmudallib since it was a case of double allocation on the same piece of land.
