A middle-aged man, Mr Olusola Adekunle, has dragged his wife to an Okitipupa Customary court, seeking dissolution of their 19-year-old marriage, on the ground that he is not safe in her hands again.
“My wife bought plots of land with her maiden name, planned to kill me but succeeded in killing our only child,” he told the court.
The petitioner also accused his wife, Adeola Adekunle, of being diabolical, claiming she attempted killing him with charm.
He also told the court that his estranged wife had visited several spiritual homes in the quest to charm him, which, he said ended in the death of their third child.
“My wife would wake up in the dead of the night without clothes and rain curses on me. She does not obey nor respect me. She even went ahead to buy two plots of land with her maiden name without my consent”, he said.
He pleaded with the court for a separation with his wife because he could no longer tolerate her.
During cross examination, the respondent, Adeola, did not controvert the allegations against her, but told the court that her husband always made her swear every time, even before masquerade, thinking that she would die.
She, however, pleaded with the court that she would amend her ways, blaming the devil for being the cause of the problem.
In his judgment, the President of the court, Mr. Adedeji O. Adebisi, held that the court cannot compel unwilling and a suffering party in a marriage to continue to suffer in the marriage, more so, when the party responsible for the suffering has not successfully been able to rebutt the claim that the petitioner is suffering under her.
He dissolved the marriage on the ground that it has failed and broken irretrievably since the petitioner has discharged the burden of proving that he had long suffered and endured for several years, and ordered the woman to refund the sum of N2,500 dowry back to the petitioner through the court.
