In a writ of summons filed by his lawyer Ahmed Garba and made available to Daily Trust, Nakande alleged that the party smuggled in 56 unqualified delegates in the list for the December 7 primary for Bassa/Jos North Federal Constituency for the 2015 general elections.
The claimant said areas where the illegal delegates were used include: Buhit, Mafara, Kakkek, Kishika, Rimi and Jengre wards of Bassa Local Government Area of Plateau State.
Those joined as defendants are Suleiman Kwande and the Independent National Electoral Commission (INEC).
While contending that the unlawful inclusion of these delegates made Kwande to emerge winner, he wants the court to declare that having failed to obtain the valid votes cast in the election, he should be disqualified as the APC candidate.
He also wants the court to make an order declaring him the winner of the primary having scored the highest valid votes and to direct INEC to accept and recognise his name as the candidate of the APC for the 2015 general elections.
