A Federal High Court in Abuja on Friday presided by Justice Gabriel Kolawole struck out the suits seeking to halt the Kogi State Governorship supplementary election billed for December 5.
In his judgement, the judge ruled that the case did not arise from a post primary election of a political party but issues from voting by the public.
He further held that by the provisions of Section 87 (7) of the Electoral Act, the Federal High Court cannot adjudicate on the merits of the election which only the election petitions tribunals constituted by the President of Court of Appeal can entertain.
Following the death of the candidate of the All Progressive Congress (APC) Abubakar Audu and the declaration of the November 21 polls as inconclusive by the Independent National Electoral Commission (INEC), the Peoples Democratic Party (PDP) candidate, Gov Idris Wada and other went to court to stop the suplmentary polls.
