A Federal High Court in Abuja has refused to stop Governor Siminalayi Fubara from spending public funds pending the hearing of the suit filed by the Rivers State House of Assembly led by Martin Amaewhule.

Justice Emeka Nwite, while refusing the application, ordered the lawmakers to serve the hearing notice on the defendants.

Judge Nwite, however, granted the motion ex parte to serve the fifth through tenth defendants in the case using substituted methods

“The plaintiffs/applicants are hereby granted leave to serve the fifth through tenth defendants/respondents with the plaintiffs/applicants’ originating and any other process (es) filed or issued in this suit by substituted means, such as by publishing them in the Nation Newspapers,” the judge held.

The suit was filed by the Rivers State House of Assembly and Martin Amaewhule, through their counsel, Joseph Daudu (SAN), against the Central Bank of Nigeria (CBN), Zenith Bank Plc., Access Bank Plc., and the Accountant General of the Federation as the 1st to 4th defendants.

The Court of Appeal in Abuja had on July 4 nullified the restraining order of a Rivers State High Court against Amaewhule and 24 other lawmakers who defected from the People’s Democratic Party (PDP) to the All Progressives Congress (APC).

Following the order, the two opposing factions of the state assembly have been operating separately.
