A Federal High Court in Abuja has fixed September 22 to hear a suit by the Osun State Government challenging the transfer of the suit against the payment of local government funds to candidates elected under the All Progressives Congress (APC).
Justice Emeka Nwite on Monday directed the parties, which include the Central Bank of Nigeria (CBN), the Accountant General of the Federation and the Attorney General of the Federation, to file, reply and exchange their processes ahead of the next adjourned date.
Osun State brought two motions, through its counsel, Musibau Adetunbi (SAN), after the Chief Judge of the Federal High Court, Justice John Tsoho, allegedly transferred the matter from Osogbo to Abuja, and asked the judge to decline jurisdiction in the matter.
Adetunbi informed the court that the government wants it to halt the hearing in the matter pending the determination of the suit lodged at the Supreme Court on August 25, and to set aside the fiat of the chief judge to transfer the matter to Abuja.

The Osun State Government had in the suit at the apex court, challenged the Attorney General of the Federation’s failure to comply with subsisting judgments of both the Federal High Court, Osogbo Division, delivered on November 30, 2022, and the Court of Appeal ruling of June 13, 2025, which recognized the local government chairmen and councillors elected on February 22, 2025.
Further, Osun State informed the court that it has wholly discontinued the suit number FHC/OS/CS/94/2025 against the Attorney General of the Federation, as it is going to file a fresh suit against it at the Supreme Court based on an affidavit of urgency filed on August 13, 2025 to stop moves to pay allocations to APC local government chairmen.
However, counsel to the AGF, Akin Olujimi (SAN), informed the court that he was the only person served with the motion for the discontinuance of the state government’s suit, and not his client, adding that the matter could proceed if the court made an order for attachment of an affidavit of service.
Counsel to the CBN, Dr Muritala Abdulrasheed (SAN), informed the court that the AGF wrote to the chief judge for the matter to be heard expeditiously by a vacation judge, adding that he had filed seven processes challenging the Osun government’s motion for stay of proceedings and against the administrative powers of the CJ to transfer the matter from Osun to Abuja.
On his part, counsel to the Accountant General of the Federation, Tajudeen Oladoja (SAN), said if the matter is not heard during the court’s vacation, it would become an academic exercise and asked the court to hear all the processes filed in the matter together.
